The Basic Law of Governance (Royal Order A/90 dated 27/8/1412H) is the Kingdom's constitutional instrument. Two articles anchor privacy:
Art 37: "Dwellings are inviolable. They shall not be entered without the permission of their owners, nor searched, except in cases specified by the law."
Art 40: "Telegraphic and postal communications, and telephone and other means of communication, shall be inviolable. They shall not be confiscated, delayed, read or listened to, except in cases set forth in the law."
Context: Art 26 (the State protects human rights in accordance with Sharia) and Art 36 (security of citizens and residents; no arrest or detention except under the law).
The PDPL, the Anti-Cyber Crime Law and the Law of Criminal Procedure give these articles operational effect.
